1. About Us and These Terms

Welcome to Salamander Tactical. This online store is operated by Salamander Tactical AS, a company registered in Norway (organisation number 930 352 586) ("we", "us" and "our"). Our website is salamandertactical.com.

These Terms of Service ("Terms") apply to your use of our website and purchases made through our online store, together with the information presented at checkout and our applicable policies. Please read them before placing an order.

Nothing in these Terms limits any mandatory rights you have under applicable consumer protection law. Where separately agreed written terms apply to a business-to-business (B2B) order, those terms take precedence over these Terms to the extent permitted by law.

2. Eligibility and Customer Information

You must be legally entitled to purchase, import, receive and use the products you order in your jurisdiction. Some products may be subject to age limits or other legal restrictions.

You agree to provide accurate and up-to-date contact, billing and delivery information. If you create an account, you are responsible for keeping your login information secure and informing us promptly of any suspected unauthorised use.

3. Products and Availability

We aim to provide accurate product descriptions, specifications, photographs and availability information. Images and displayed colours may vary slightly depending on your device and screen settings. Product specifications and compatibility information should be checked carefully before ordering.

Availability may change. If a product becomes unavailable after you place an order, we will contact you to discuss the available options, including an alternative, a later delivery where agreed, or a refund in accordance with applicable law.

We may modify or discontinue products, but changes will not deprive you of rights relating to orders already placed.

4. Orders and Contract Formation

When you complete checkout and submit an order, you place an order for the products shown at the total price and on the conditions presented to you. We will send an order confirmation to the email address provided.

We may contact you if information needs clarification, a product is unavailable, or an obvious pricing or technical error has occurred. Any cancellation, correction or refusal of an order will be handled in accordance with applicable contract and consumer law. If we cancel an order for which payment has been received, we will refund the relevant amount.

Please contact us as soon as possible if you need to change or cancel an order. We cannot guarantee changes after processing or dispatch. Your statutory cancellation and withdrawal rights remain unaffected.

5. Prices, Payment and VAT

Product prices are shown in the currency selected or displayed in our store. The applicable product total, shipping charges and any taxes collected by us will be shown during checkout before you confirm your purchase.

Orders delivered within Norway: Prices for customers in Norway include applicable Norwegian value-added tax (VAT).

Orders delivered outside Norway: We do not charge Norwegian VAT on orders shipped outside Norway. Import VAT, customs duties and carrier clearance or handling fees may be charged separately upon import into the destination country, as explained below.

Any special pricing or VAT treatment for business customers will be specified in the relevant offer, invoice or checkout information, as applicable. Prices and promotions may change prospectively, but not retroactively for accepted orders except as permitted by law.

Payment is processed using the payment options presented at checkout. You must be authorised to use your chosen payment method.

6. International Shipping, Customs and Import Duties

Orders shipped outside Norway are supplied under DAP (Delivered at Place), Incoterms® 2020, unless we expressly agree otherwise in writing. We do not ordinarily ship international orders on a DDP (Delivered Duty Paid) basis.

Under DAP, we arrange transport to the agreed destination, while the customer is responsible for applicable import clearance, import VAT, customs duties and import-related carrier charges. These additional charges are not included in the product price or shipping charge unless expressly stated otherwise.

The customer is responsible for providing any information or cooperation reasonably required for lawful import clearance. Any consequences of failing to complete required import formalities will be assessed in accordance with the agreed delivery terms and applicable law.

We comply with applicable export and shipping restrictions and may be unable to fulfil orders to certain destinations or for certain products. Customers should check local import, ownership and use requirements before ordering. Nothing in this section removes our own legal obligations as seller or exporter.

7. Processing, Delivery and Risk of Loss

Orders are normally processed within 1–2 business days, excluding weekends and public holidays. Estimated delivery times are generally 1–4 business days within Norway, 3–8 business days within Europe and 5–12 business days for other destinations. These are estimates, not guaranteed delivery dates.

We provide tracking information when available after dispatch. If delivery is delayed, damaged or missing, please contact us so that we can investigate and assist.

For consumer purchases, risk of loss or damage passes in accordance with mandatory consumer law. In particular, where Norwegian consumer sales law applies and we arrange carriage, risk normally passes when the consumer, or a person designated by the consumer other than the carrier, physically receives the goods. Different rules may apply if the consumer independently appoints a carrier that we did not offer.

For business purchases and international trade, risk allocation is determined by the agreed terms, including DAP where applicable, subject always to mandatory law.

8. Returns and Statutory Right of Withdrawal

We offer a voluntary 30-day return policy for eligible unused products, including sale items, subject to the conditions in our Return & Refund Policy. A product that has been used is not eligible for a voluntary change-of-mind return under this policy.

Consumers in Norway and the EU/EEA generally have a separate statutory 14-day right of withdrawal for eligible online purchases, subject to applicable exceptions. This right may allow a customer to inspect a product as reasonably necessary to determine its nature, characteristics and functioning. Excessive handling may justify a deduction for diminished value where permitted by law.

Statutory rights of withdrawal and rights relating to faulty, damaged or incorrectly supplied products are not restricted by our voluntary 30-day return conditions. Full instructions, conditions and refund information are set out in our Return & Refund Policy.

9. Defects, Complaints and Warranties

If a product is faulty, damaged, not as described or otherwise fails to conform to the contract, please contact hello@salamandertactical.com with your order number and details of the issue.

Consumers retain all applicable statutory rights to complain about non-conforming goods and seek appropriate remedies. Under Norwegian consumer law, the relevant complaint period is generally two years, or five years for goods intended to last substantially longer, subject to the legal requirements applicable to the claim.

Any manufacturer's warranty is additional to, and does not replace or reduce, applicable statutory consumer rights. Terms applicable to commercial purchases may differ, subject to applicable law and any written B2B agreement.

10. Business-to-Business Purchases

We also sell to businesses and other professional customers. A purchase made wholly or mainly for business purposes may be subject to different statutory rules from a consumer purchase.

Where a separate quotation, invoice, distribution agreement or other written B2B agreement has been accepted, its specific terms take precedence in the event of a conflict with these general Terms, to the extent permitted by law.

Consumer-only statutory withdrawal rights do not automatically apply to business purchases. Any voluntary returns available to business customers are governed by our published return policy or a separate written agreement.

11. Lawful Use and Product Restrictions

Our products are intended to be purchased and used lawfully and in accordance with applicable safety instructions, product specifications and local regulations. Certain shooting, optical, electronic or other equipment may be restricted in some jurisdictions.

You must not use our website or products for unlawful purposes or provide false or misleading information concerning the intended destination, recipient or use of an order. We may refuse or cancel transactions where necessary to comply with applicable law, sanctions, export controls or other legal obligations. Any refund arising from a cancellation will be handled in accordance with applicable law.

12. Intellectual Property

Unless otherwise indicated, the website's original text, images, graphics, branding, layout and other content are owned by Salamander Tactical AS, its licensors or the respective rights holders, as applicable and are protected by applicable intellectual property law.

You may access and use the website for normal browsing and shopping. You may not copy, reproduce, republish or commercially exploit protected content without the permission of the relevant rights holder, except where permitted by law.

Third-party brand names and trademarks remain the property of their respective owners.

13. Reviews, Feedback and User Content

If you submit a review, photograph, suggestion or other content through our website, you confirm that you have the rights necessary to submit it and that it does not infringe the rights of others or violate applicable law.

You grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce and use that content in connection with operating, improving and promoting our business, to the extent permitted by law. This does not transfer ownership of your content or override your privacy and data protection rights.

We may moderate or remove content that is unlawful, misleading, abusive, infringing or otherwise violates reasonable website rules, subject to applicable law.

14. Third-Party Services and Shopify

Our online store is powered by Shopify. Sales made through this store are contracts between the customer and Salamander Tactical AS, not Shopify. Shopify provides the ecommerce platform but is not the seller of the products.

Our website may contain links to third-party websites or offer services provided by third parties, including payment, delivery, analytics and customer-service providers. Separate terms and privacy notices may apply when you choose to use those services.

We are not responsible for independently operated third-party websites beyond the extent required by applicable law. Nothing in this section excludes responsibility that we are legally required to bear in connection with your purchase.

15. Privacy and Cookies

Our handling of personal information is explained in our Privacy Policy. Information about cookies and similar technologies is available in our Cookie Policy.

Where applicable, you can use the privacy controls on our website to manage optional cookie categories and other available privacy choices.

16. Website Availability and Limitation of Liability

We aim to keep our website accurate, secure and available, but cannot guarantee uninterrupted access or that technical errors will never occur. We may temporarily suspend parts of the website for maintenance, security or operational reasons.

To the extent permitted by applicable law, we are not responsible for losses arising solely from circumstances outside our reasonable control. For business customers, any additional limitations of liability must be interpreted in accordance with applicable law and any separate written agreement.

Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, personal injury, defective products, failure to deliver, non-conforming goods or any other matter to the extent such liability cannot lawfully be excluded or limited. Your mandatory consumer rights remain unaffected.

17. Changes to These Terms

We may update these Terms to reflect changes in our business, services or legal requirements. The latest version will be published on this page with an updated date.

Changes will not retroactively alter the terms of an existing purchase without a lawful basis or any agreement required by law. Where required, we will provide notice of material changes.

18. Governing Law and Disputes

These Terms are governed by Norwegian law, subject to mandatory rules that may apply to a customer in another jurisdiction.

Where applicable law gives a consumer mandatory protections under the law of their country of residence, these Terms do not deprive the consumer of those protections. Nothing here limits a consumer's right to bring a claim before a court or competent authority where such a right is provided by mandatory law.

If you have a concern about an order, please contact us first so we can try to resolve it. Consumers may also be entitled to assistance from relevant consumer protection or dispute-resolution bodies.

19. Severability and General Provisions

If a provision of these Terms is held invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law. Our failure to enforce a provision on one occasion does not necessarily constitute a waiver of that provision.

These Terms, the information presented at checkout, our referenced policies and any specifically agreed written terms form the relevant contractual framework for purchases from our store. In the event of a conflict, mandatory law and any valid specifically agreed terms take precedence.
